Tapuchino Terms of Use

These Terms of Use ("Terms") govern your use of the mobile game Tapuchino: Idle Cafe Tycoon (the "Game", "app") and of this website, tapuchino.happytoothapp.com (together, the "Service"), published by HappyTooth ("we," "our," or "us").
By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, do not use the Service. Your use of the Service is also subject to our Privacy Policy, which explains what data the Game processes; these Terms do not repeat it.
1. What Tapuchino is
Tapuchino is a single-player coffee-shop management game. It has no user accounts, no login, no cloud save, no user-generated content, and no chat or social features. All of your progress is stored locally on your device only. If you uninstall the app, reset the app's data, or lose or replace the device, your progress and any virtual items — including Golden Beans — are lost and cannot be restored by us.
2. Licence to play
We grant you a personal, non-exclusive, non-transferable, revocable, limited licence to install and use one copy of the Game on devices you own or control, for your own private, non-commercial entertainment. We reserve all rights not expressly granted.
3. Acceptable use
You agree not to:
- copy, sell, rent, sublicense, distribute or publicly perform the Game or its assets, except as permitted by applicable law;
- reverse engineer, decompile or disassemble the Game, or attempt to derive its source code, except to the extent applicable law expressly permits it;
- modify, patch or tamper with the Game, its files, its network traffic or its locally stored save data, including to obtain Golden Beans or in-game items you did not legitimately earn or purchase;
- use cheats, automation, bots, memory editors, emulator manipulation, or any tool designed to alter gameplay or rewards;
- manipulate rewarded advertising to obtain rewards without genuinely viewing the ad;
- use the Service for any unlawful purpose, or in a way that infringes the rights of others.
We may take reasonable steps to protect the Game, including releasing updates that detect or prevent tampering. Because the Game keeps no accounts, we cannot suspend or terminate an account; we may, however, stop distributing the Game or discontinue the Service, and your licence terminates if you breach these Terms.
4. Golden Beans and other virtual items
The Game offers Golden Beans, an in-game currency sold as a consumable in-app purchase in three tiers (100, 550 and 1200 Golden Beans), as well as items, upgrades and other content unlocked in play. The following applies to Golden Beans and to all in-game items and content (together, "Virtual Items"):
- No monetary value. Virtual Items are not money, credit, or any kind of property, balance or financial instrument. They have no cash value and cannot be exchanged, redeemed or cashed out for real money, goods or services outside the Game.
- Licence, not ownership. When you obtain Virtual Items you receive a limited, personal, revocable licence to use them inside the Game. You do not own them.
- Non-transferable. Virtual Items cannot be given, sold, traded, gifted or otherwise transferred to another player, another device, or anyone else. Selling or trading them outside the Game is prohibited.
- Non-refundable. Once delivered, Virtual Items are non-refundable, except where a refund is required by applicable law or granted under the refund policy of the store you purchased through (see section 5).
- Local only. Because progress is stored on your device (section 1), Virtual Items are lost if the app is uninstalled or its data is cleared, and are not recoverable, transferable to a new device, or replaceable by us.
- We may change them. We may add, remove, rebalance, reprice, change the effect of, or discontinue any Virtual Item or the way it is earned or spent, as part of ordinary game updates and balancing. If we permanently discontinue the Game or the Service, unused Virtual Items are forfeited without compensation, to the extent permitted by law.
5. Purchases are made through Apple and Google
All in-app purchases are processed by Apple (App Store) or Google (Google Play), using a purchase infrastructure operated on our behalf by RevenueCat. We never receive, see or store your payment card or bank details.
Your purchase is a transaction with the platform store and is also governed by that store's terms and refund policy. Refunds, billing errors, duplicate charges and payment disputes are handled by Apple or Google — we cannot issue, reverse or force a refund. Prices are shown in the store before you confirm, and may vary by country, currency, taxes and over time.
The Game sells consumable purchases only. There are no subscriptions and nothing in Tapuchino renews automatically or recurs, so there is nothing to cancel.
If a purchase does not arrive in the Game, contact us at happy.toothapp@gmail.com and we will try to help; if the charge itself is the issue, please raise it with Apple or Google.
6. Advertising
The Game shows optional rewarded video ads served by Google AdMob. You are never required to watch an ad in order to keep playing: you choose to watch one in exchange for an in-game bonus, and you can simply not tap the offer.
Ad content is supplied by third parties and is not created, reviewed or controlled by us. We are not responsible for advertised products, services, claims or the websites an ad links to; interacting with an ad is at your own risk and subject to the advertiser's own terms. How ad-related data is handled is described in our Privacy Policy.
7. Intellectual property
The Game and all of its content — including its code, artwork, characters (such as the guide "Mr. Luwak"), names, logos, user interface, music, sound effects, text and audiovisual elements — are owned by HappyTooth or its licensors and are protected by copyright, trade mark and other laws. "Tapuchino" and the Tapuchino logo are our marks. Nothing in these Terms transfers any of these rights to you.
You may create and share screenshots or video of your own gameplay (for example streams, reviews or let's-plays) for non-commercial or ordinary creator use, provided you do not imply that we endorse or sponsor you, and you do not use our marks in a way that suggests you are us.
8. Availability, updates and changes to the Game
The Service is provided on an "as is" and "as available" basis. We may update, patch, modify, add or remove features, rebalance gameplay and economy, or suspend or discontinue the Game or any part of it, at any time and without notice. Updates may change game balance, the cost or effect of Virtual Items, and how content is unlocked. Continued play may require installing the latest version and a compatible, supported device and operating system; the Game may require an internet connection for purchases and ads.
9. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Service is provided without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that the Game will be free of bugs, that progress or Virtual Items will never be lost, or that the Game will run on every device.
Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded or limited under the law of your country of residence — including, in the European Economic Area, statutory conformity rights.
10. Limitation of liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, loss of progress, loss of Virtual Items, loss of profits, goodwill or business, arising out of or in connection with your use of the Service, however caused and on any theory of liability.
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the total amount you actually paid us or through the platform stores for in-app purchases in the twelve (12) months before the event giving rise to the claim, and (b) EUR 20.
These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for intentional misconduct or gross negligence.
11. Indemnity
You agree to indemnify and hold harmless HappyTooth and its personnel from and against any claims, damages, losses, liabilities and reasonable legal costs arising out of your breach of these Terms, your misuse of the Service, or your unlawful use of the Service, to the extent such claims are caused by you. This does not apply to the extent the claim results from our own breach or wrongdoing.
12. Children and age
The Game is a general-audience management game and is not directed at children under 13, and we do not knowingly collect personal data from children under 13. The Game's official age rating is the one shown on its App Store and Google Play listings; the store rating prevails if it differs from anything stated here.
If you are a minor under the law of your country, you may use the Game only with the involvement and consent of a parent or legal guardian, and that parent or guardian accepts these Terms on your behalf. Parents and guardians are responsible for supervising play and for purchases made on their device — we recommend enabling the purchase restrictions and password/biometric confirmation offered by iOS Screen Time or Google Play parental controls. Kids' privacy is addressed in our Privacy Policy.
13. Third-party services and links
The Service uses and links to third-party services (including Apple, Google Play, Google AdMob, RevenueCat and Firebase) and may link to third-party websites. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services or their content, availability or accuracy, and your use of them is at your own risk.
14. Governing law and jurisdiction
These Terms are governed by the laws of Poland, excluding its conflict-of-law rules, and the courts of Poland have jurisdiction over any dispute arising out of or relating to these Terms or the Service.
If you are a consumer resident in the European Union or another jurisdiction whose law gives you the right to bring proceedings in, and to the protection of the mandatory law of, your country of residence, nothing in this section removes that right.
15. Changes to these Terms
We may update these Terms to reflect changes to the Game, to our practices, or to legal requirements. When we do, we will change the "Updated at" date at the top of this page, and for material changes we will provide notice in the app or on this website where reasonably practicable. Changes take effect when published. If you continue to use the Service after the changes take effect, you accept the updated Terms; if you do not accept them, stop using the Service and uninstall the Game.
16. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the remaining provisions stay in force and the unenforceable provision applies to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets, provided your rights are not reduced.
